Terms of Sale
50% (non-refundable deposit) due on all jobs prior to commencement of work. Balance due upon completion, prior to the
release of final files or taking a website live, or uploading of files to clients host/server.
Late Fees
A .5% service charge is payable on all overdue balances. Additional .5% service charges will accrue every 15 days
until payment is received in full.
License or Right of Copyright
The grant of any license or right of copyright is conditional on receipt of full payment. Once payment is received in
full all work created becomes the property of the client.
Payment Schedules
Payment schedules can be created to break up the project total into monthly increments - provided that the client
agrees to pay a 20% interest on the outstanding balance owed. This is CreatiVerve's option and can be negotiated prior
to a project onsets. CreatiVerve reserves the right not to offer this option to any client, company and/or person.
Printing Services
CreatiVerve is not a printer nor does it provide printing services. CreatiVerve does have relationships with many
different well established/recognized printing companies and can provide assistance in regards to project quotes
and act as liaison on behalf of the client upon request from the client at no extra charge.
Bartering/Trade
CreatiVerve does NOT participate in Bartering. All services require full payment.
Client's Modifications
It is the Client’s responsibility to check the proof(s) carefully and thoroughly. There will be no charges to the Client
for revisions or corrections or additions made necessary by errors on the part of CreatiVerve prior to authorization.
Any/all other changes requested by the Client shall be considered Client's Modifications if they are requested after the
acceptance of the Client's authorization. Client Modifications and/or changes from the original submitted specifications
and submitted material will be subject to an additional charge. After verbal and/or signed final proof approval,
any/all changes will be billed separately.
Project Agreements
Once the project has been discussed and agreed upon by both the client and CreatiVerve a legally-binding contract
will be created with all of the project specifications and it must be signed by both parties prior to commencment of
the project in question.
Design Credit
CreatiVerve will include a small text line, graphic or web design credit on the completed projects which will
state as follows... "Custom Graphic Design by: CreatiVerve, 877.71.CV360 (CV360.com)",
"Designed by: CreatiVerve, 877.71.CV360 (CV360.com)", "Website Designed by: CreatiVerve, 877.71.CV360 (CV360.com)",
"Website Designed & Hosted by: CreatiVerve, 877.71.CV360 (CV360.com)",
"Hosting Services Provided by: CreatiVerve, 877.71.CV360 (CV360.com)",
"Website Designed by: CreatiVerve, 877.71.CV360 (CV360.com)", or "CV360.com, 877.71.CV360"; unless client requests in
writing that the credit not be added and it is agreed upon by both parties.
Right to Promote/Distribute
CreatiVerve reserves the right to use any submitted materials or finished product for promotional purposes. If
available, CreatiVerve reserves the right to distribute free samples of your project.
Right to Refuse
CreatiVerve reserves the right to refuse service for any reason. In no event will CreatiVerve be liable to the Client
or any third party for any damages, including in lost profits, lost savings or other incidental, consequential or
special damages arising out of the refusal of services even if CreatiVerve has been advised of the possibility of such
damages.
Indemnification
The client will indemnify and hold harmless the designer, programmer, and CreatiVerve, from any and all loss, cost
expense, and damages on any and all manner of claims, demands, actions and proceeding that may be instituted against
the designer, programmer and/or CreatiVerve on the grounds alleging that said design created violates any copyright or
any proprietary right of any person. It is the clients responsibility to screen the use of photos or artwork which are
copyrighted or have copyright pending. The Client certifies that they own the rights to use the image(s)/materials
provided to CreatiVerve for creation/reproduction.
